Sichuan Provincial Administration of Traditional Chinese Medicine

  In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Releasing 'the Plan of Institutional Reform in Sichuan Provincial Government' and 'the Opinion on the Implementation of the Plan of Institutional Reform in Sichuan Provincial Government' (ChuanWeiFa[2009] No.24),Traditional Chinese Medicine Administration of Sichuan Province ( referred to as the"SPATCM"),which is an administrative body taking assisting roles of departments or equivalents under the Health Department of Sichuan Province,is hereby established.

  I.             Adjustment of Functions

  1)      Items of administrative approval as canceled by the provincial government are to be canceled;

  2)      Efforts should be reinforced to promote the development of and carry on traditional Chinese medicine (TCM) undertakings and minority medicine undertakings,and to develop TCM culture;

  3)      Efforts should be reinforced in respect of the training of talents in TCM and the succession of TCM knowledge,and to promote the occupational quality and competence of TCM practitioners; and

  4)      Efforts should be reinforced to direct the practice of TCM in rural and community health services. 

  II.          Major Functions

  1)      To implement thoroughly state laws,rules,guidelines and policies in relation to TCM (hereinafter including integrated traditional and western medicine as well as minority medicine),draw up and supervise the implementation of relevant local rules,regulations,administrative codes and technical standards,participate in the planning and enforcement of major programs in TCM,and implement trade administration on the practice of TCM throughout the province;

  2)      To supervise and administer TCM treatments,disease prevention,healthcare,rehabilitation and clinical medications throughout the Province,plan,direct and coordinate the reform to the establishment scheming and operation mechanism for institutions for TCM treatment and research,supervise the implementation of administrative codes and technical standards for various institutions for TCM treatment and healthcare,draw up service norms and occupational ethic codes for TCM practitioners throughout the province,and promote moral improvement within the sector of TCM throughout the province;

  3)      To direct the practice of TCM in rural and community health services,direct the exploration,summarization and enhancement of medical theories,skills and medications in respect of minority medicine throughout the province,and supervise and coordinate the practice of integrated traditional and western medicine in institutions for medical treatment and research throughout the province;

  4)      To arrange for general surveys of TCM resources throughout the province,promote the protection,development and reasonable utilization of TCM resources,participate in the formulation of development planning and industrial policies for the industry of Chinese medicines as well as policies for supporting TCM,and participate in the formulation of the system of basic medicines throughout the province;

  5)      To draw up development planning for talents in TCM,participate in the formulation of development planning of TCM education as well as of standards for the qualifications of professional technical personnel in TCM and ensure the implementation of the same,work with relevant departments in the work in respect of succession and continued education of TCM knowledge as well as the training of relevant personnel,and take part in directing the reform to education and teaching of TCM throughout the province;

  6)      To draw up and arrange for the implementation of the planning for research and technological development in respect of TCM throughout the province,direct the improvement of conditions and abilities for scientific research in TCM,manage national and provincial key projects of scientific research in TCM throughout the province,and promote the transformation,application and popularization of the results of scientific research in TCM;

  7)      To protect TCM treatments and Chinese medicine manufacturing and processing techniques that are on the verge of extinction throughout the province,arrange for the classification and studies of ancient literature in TCM and encourage the succession of culture of TCM,put forth suggestions on the protection of TCM as intangible cultural heritage,and promote the popularization of TCM knowledge in respect of disease prevention and treatment. 

  8)      To direct communication and cooperation in the circle of TCM throughout the province with the international community and with Hong Kong,Macau and Taiwan,and promote the worldwide popularization,application and dissemination of TCM techniques;

  9)      To undertake matters of administrative approval as released by the provincial government; and

  10)  To undertake other matters assigned by the provincial government and the Health Department of Sichuan Province. 

  III.       Constitution of the Administration

  On the basis of the above functions,5 internal offices are set up in the Administration.

  1)      General Office (Office for Policies and Law and Supervision)

  The General Office shall be responsible for official papers and telegrams,conference organizing,confidential documentation,file-keeping,performance management,supervision of governance affairs,open administration,press release and publicity,matters in relation to letters and visits from the public,information transmission,security and confidentiality,finance and logistic services; draw up local rules and regulations in respect of TCM as well as relevant standards; be responsible for matters of administrative approval,and undertake relevant matters in relation to administrative reconsideration,administrative litigation,and the review of regulatory documents of the Administration; take charge of supervision and administration of institutions,practitioners,medical services and advertisements of and for TCM; ensure the well-disciplined provision of TCM treatments,and supervise the handling of major cases of law violation in respect of TCM treatments; ensure the progress in the culture of TCM and the popularization and publicity of TCM knowledge in respect of disease prevention and treatment; and undertake specific tasks of the Team of Sichuan Province for Inter-departmental Coordination in respect of TCM.

  2)      Office for Planning and Finance

  The Office for Planning and Finance shall draw up planning for medium-and-long-term development and resource allocation in respect of TCM undertakings; take charge of the management of special funds,infrastructure investment,project funds in respect of TCM throughout the province appropriated by central and provincial finance,as well as management of budgets and final accounts for expenses in the Administration and subordinate entities; take charge of data and statistics in respect of TCM throughout the province; be responsible for administration of governmental uniform tendering and purchasing in subordinate entities; undertake finance and auditing,supervision of state-owned assets and examination or approval of infrastructure projects subject to authority in subordinate entities; make overall planning of support for TCM and of reasonable utilization of loan funds; and participate in the formulation of relevant policies and administration rules for TCM treatment items,pricing standards and basic medial insurance. 

  3)      Office for Medical Administration (Office for Minority Medicine and Grassroots TCM)

  The Office for Medical Administration shall draw up and ensure the implementation of schemes for TCM prevention of major diseases throughout the province; formulate and supervise the implementation of administration rules and standards for TCM institutions,integrated traditional and western medicine institutions,minority medicine institutions and healthcare institutions as well as the application of techniques in such institutions; direct and arrange for the practice of TCM in rural health services and community health services; formulate and supervise the implementation of administration rules and technical standards for TCM treatments,disease prevention,healthcare,rehabilitation,nursing and clinical medications,direct the practice of TCM in TCM hospitals and other medical institutions,and supervise the enforcement of the qualification system and service codes for practitioners of TCM treatments and healthcare; participate in the formulation of catalogues of basic medicines in the province; and take part in the handling of emergencies of public health.

  4)      Office for Technology

  The Office for Technology shall draw up and ensure the implementation of schemes for scientific research and technological development in TCM throughout the province; direct the improvement of conditions for TCM scientific research and of TCM technological capabilities; organize and manage key projects for TCM scientific research,and promote the transformation,application and popularization of TCM scientific and technological results; arrange for the exploration,summarization and enhancement of ancient literature and treatment skills in respect of TCM and minority medicine,arrange for general surveys of TCM resources,and promote the protection,development and reasonable utilization of TCM resources; put forth suggestions on protecting TCM as intangible cultural heritage; and participate in the formulation of development planning and industrial policies for the industry of TCM.

  5)      Office for Personnel and Education (Office for International Cooperation)

  The Office for Personnel and Education shall draw up development planning for talents in TCM throughout the province,and participate in the formulation of and ensure the implementation of standards for the qualifications of professional technical personnel in TCM; subject to administrative authority,take charge of the institutional organization and personnel affairs in the Administration and subordinate entities; formulate and ensure the implementation of development planning for TCM secondary education,occupational education,adult education,succession education and continuing education as well as training of relevant talents; participate in the reform to education and teaching of TCM; carry out communication and cooperation in the circle of TCM throughout the province with the international community and with Hong Kong,Macau and Taiwan; and keep in contact with relevant academic associations.

  Party Committee of the Administration shall be responsible for Party-and-mass relationship and disciplinary inspection and supervision in the Administration and subordinate entities. 

  IV.        Personnel and Number of Leaders

  The Administration is to have 31 staff,including one Director and 2 Deputy Directors. Party secretaries are to be appointed by the CPC Sichuan Provincial Committee. The Administration is to have 5 officials of leading roles of divisions or equivalents and 5 officials of assisting roles of divisions or equivalents.

  The Administration is to have at most 3 employees for logistic purpose.

  V.           Miscellaneous

  Provisions for the establishment,functions,and institutional organization of subordinate entities shall be formulated otherwise.

  VI.        Supplementary Provisions

  These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
