Sichuan Provincial Bureau of Forestry

  In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Printing and Releasing'the Plan of the Institutional Reform of Sichuan Provincial Government'and'the Opinion on the Implementation of the Plan of the Institutional Reform of Sichuan Provincial Government'(CWF〔2009〕No.24),the Sichuan Provincial Bureau of Forestry,( "SPBF" for short),which is a  department of the provincial government,is hereby established.

  I.       Adjustment of Functions

  1)      Canceling such items of administrative approval as released by the provincial government;

  2)      Reinforcing the functions of protecting and rationally developing forest,wetland,desert,terrestrial wildlife resources,optimizing the allocation of forestry resources,promoting sustainable forestry development,and organizing,coordinating,directing and supervising the protection of wetland throughout the province and desertification control; and

  3)      Reinforcing the functions of organizing and directing forestry reforms,promoting forestry development in rural areas,and safeguarding,according to law,the legal rights and interests of farmers in relation to forestry operations. 

  II.    Major functions

  1)      To supervise and administer activities in relation to the forestry sector and ecological improvement throughout the province; implement state guidelines,policies,laws and regulations in relation to forestry; draft provincial policies,development strategies,medium and long-term plans and local regulations in relation to forestry and ecological improvement; supervise the implementation of the aforesaid policies,plans,etc.; draft relevant local standards and rules and supervise the implementation of such standards and rules; organize investigations,dynamic monitoring activities and assessments of forest,terrestrial wildlife,wetland and desert resources throughout the province and conduct unified releases of relevant information; and improve the forestry ecological civilization;

  2)      To organize,coordinate,direct and supervise afforestation throughout the province; draft provincial afforestation plans,annual guiding plans and relevant provincial standards and rules and supervise the implementation of such plans and standards; direct the cultivation of various public welfare and commercial forests; direct the prevention and control of soil erosion by taking biological control measures such as afforestation,forest conservation and grass-planting; organize,direct and supervise voluntary tree-planting and other afforestation activities; undertake the work in relation to dealing with climate changes that may affect the forestry sector; and undertake the specific work of the Greening Commission of Sichuan Province;

  3)      To supervise and administer the protection and development of forestry resources throughout the province; implement the state forest-cutting quota and forest protection and utilization plans; set the provincial forest-cutting quota and supervise the implementation of such a quota; supervise and examine whether trees are cut and transported by license; organize investigations,dynamic monitoring activities and statistic services in relation to forestry resources throughout the province; organize and direct the administration of forests and forest ownership; organize the registration and license-issuing work in relation to forest ownership; draft provincial plans for forest protection and utilization and direct the implementation of such plans; undertake,according to law,the initial examination of forest expropriation and occupation; administer the state-owned forestry resources in the major state-owned forest areas; and undertake the examination and approval of ownership changes of state-owned forestry resources;

  4)      To organize,coordinate,direct and supervise the protection of wetland of the province; implement state plans and standards in relation to wetland protection; draft provincial plans for wetland protection and relevant local standards and regulations; establish,protect and administer wetland protection areas,wetland parks,etc.; supervise whether wetland is utilized in a rational way; and organize and coordinate the execution of relevant international wetland conventions in the province;

  5)      To organize,coordinate,direct and supervise desertification control throughout the province; implement state plans,standards and regulations in relation to desertification and stone desertification control and prevention,as well as building closing areas for protection in desertified land; draft relevant local standards and regulations and supervise the implementation thereof; supervise whether desertified land is utilized rationally; organize and direct the examination and approval in relation to the influence of construction projects on desertification; organize and direct sandstorm forecasts and emergency handling; and organize and coordinate the execution of relevant international conventions to combat desertification in the province;

  6)      To organize and direct the protection and rational development and utilization of terrestrial wildlife resources in the province; draft the catalogue of terrestrial wild fauna and flora under special protection of the province and release the catalogue upon approval of the provincial government; organize and direct,according to law,the helping and breeding,habitat restoration and expansion,and the monitoring of epidemic diseases and their sources of terrestrial wildlife; supervise and administer the hunting or collection,breeding or cultivation and utilization of terrestrial wildlife throughout the province; supervise and administer wildlife imports and exports; and examine and report for approval endangered species imports and exports,as well as exports of wild fauna under state or provincial protection,rare tree species,rare wild flora and their products;

  7)      To supervise and administer forestry conservation areas in the province; direct,according to law,the construction and administration of conservation areas covering forests,wetland,deserts and terrestrial wildlife throughout the province; organize and coordinate the execution of relevant international conventions; supervise and administer the work in relation to botanic species resources,the safety of genetically modified organisms and the protection of new botanic species; and undertake biodiversity protection as assigned;

  8)      To carry forward forestry reforms of the province and safeguard the legal rights and interests of farmers and other business operators to conduct forestry operations; implement important state forestry reform opinions and policies in relation to the collective forest ownership system and important state-owned forest areas and tree farms; draft provincial opinions and policies in relation to the implementation of important forestry reforms and direct and supervise the implementation thereof; draft provincial policies and measures to promote forestry development in rural areas and safeguard the legal rights and interests of farmers and other operators to conduct forestry operations; direct and supervise contract forestry operations and forestry ownership circulation in rural areas; direct the mediation and settlement of forestry ownership disputes and the arbitration of forestry contracting agreement disputes; undertake,according to law,the work in relation to reconverting farmland to forests; and direct the establishment and administration of state-owned tree farms (nurseries),forest parks and grass-roots forestry working institutions;

  9)      To supervise and examine the exploitation and utilization of forest,wetland,desert and terrestrial wildlife resources by various sectors in the province; implement state polices and trade standards in relation to optimizing allocation of forestry resources; draft provincial plans,policies and measures for forestry development and supervise the implementation thereof; organize and direct the supervision over forestry product quality; and direct the comprehensive development of forestry in mountainous areas;

  10)  To organize,coordinate,direct and supervise forest fire prevention of the province; organize and coordinate the fire prevention and fighting by armed forest police forces and specialized forest fighting groups; undertake the specific work of the provincial forest fire prevention headquarters; regulate administrative law enforcement in the forestry sector of the province; direct the forest police activities in the province,administer the forest police and direct the investigation into major cases of the province in relation to violation of forestry laws; and direct pest prevention and control and the relevant quarantine in terms of forestry of the province;

  11)  To direct and coordinate the work in relation to the forestry economy of the province; implement state fiscal,financial,price and trade policies and other economic control policies in relation to forestry and ecological improvement; organize and direct the establishment and implementation of a ecological compensation mechanism for forestry and ecological improvement throughout the province; draw up budgets of the Forestry Bureau and organize the implementation thereof; provide budgetary advices concerning special provincial financial funds for forestry; administer and supervise provincial forestry funds; administer provincial state-owned forestry assets; providing advices in relation to provincial investment scales and directions of forestry fixed assets of the province and the arrangements of provincial financial funds; examine and submit for approval,within the stipulated authority,the fixed asset investment projects as stated in annual plans and other plans; and formulate provincial annual production plans for forestry and ecological improvement; 

  12)  To undertake the science and technology,publicity,education and foreign affair work in relation to forestry and ecological improvement of the province,and direct the improvement of forestry personnel of the province;

  13)  To undertake relevant administrative approval affairs as released by the provincial government; and

  14)  To undertake other tasks assigned by the provincial government.

  III.Constitution of the Bureau 

  On the basis of the functions above,12 internal offices are set up under the Forestry Bureau of Sichuan Province.

  1)      General Office

  The General Office shall be responsible for: the work in relation to messages,meeting affairs,vital documents and files and other work in relation to routine operation of the Bureau; the work in relation to information,inspection,confidentiality and visitor reception; directing the work in relation to forestry ecological civilization and ecological culture improvement; and administering financial affairs and state-owned assets of the Bureau.   

  2)      Office for Policies and Regulations (Office for Administrative Approval)

  The Office for Policies and Regulations shall be responsible for: conducting researches and providing comprehensive guideline and policy advices for forestry and ecological improvement of the province; drafting provincial forestry legal system improvement plans and annual work plans; drafting local forestry regulations; undertaking the work in relation to forestry law enforcement supervision,administrative actions,administrative reviews and administrative punishments,as well as coordinating significant issues arising during the administrative law enforcement process; forestry administrative approval and licensing; organizing and coordinating provincial forestry reforms and forestry development of the rural areas; drafting provincial policies and measures to promote forestry development in rural areas and safeguard farmers'legal rights and interests in forestry operations,as well as organizing the implementation thereof; directing the administration of the contracting and circulation of forest land and forests in rural areas,as well as forest ownership; supervising the mediation and settlement of forest ownership disputes and the arbitration of disputes over forest contracting agreements.

  3)      Office for Afforestation Administration (Office for the Greening Commission of Sichuan Province)

  The Office for Afforestation Administration shall be responsible for: the provincial administration of quality of seedlings,afforestation and forest operations; directing the work in relation to the soil erosion prevention and control by means of biological measures such as tree and grass planting,the cultivation of various public welfare and commercial forests,the prevention,control,quarantine,monitoring and forecasting of pests,and the construction and administration of state-owned tree farms (nurseries) and forest parks; drafting provincial regulations and rules for dealing with climate changes which may affect forestry,as well as organizing the implementation thereof; conducting researches and drafting provincial policies and regulations in relation to desertification prevention and control,as well as organizing the implementation thereof; and undertaking the specific work of the Greening Commission of Sichuan Province.

  4)      Office for Forestry Resource Administration (Office for Timber Sector Administration)

  The Office for Forestry Resource Administration shall be responsible for: conducting researches,dynamic monitoring activities and assessments of forestry resources in the province,as well as conducting unified releases of relevant information; drafting provincial policies,measures and technological requirements in relation to sustainable development of forestry,as well as setting and making know to lower levels the provincial quota for forest falling; supervising the tree cutting and transportation by license,the forest land expropriation,occupation and development,and the examination and acceptance of afforestation and forest conservation projects; and directing the administration and utilization of forestry resources,forestry administrative law enforcement and timber inspection stations.

  5)      Office for Wildlife Protection and Natural Conservation Area Administration  

  The Office for Wildlife Protection and Natural Conservation Area Administration shall be responsible for: directing the helping and breeding of terrestrial wildlife and the restoration and expansion of wildlife habitats; supervising and administering the terrestrial wildlife hunting,import and export,collection,breeding,cultivation,utilization,special marks and disease and disease source monitoring throughout the province; undertaking the work in relation to the establishment and administration of forest and terrestrial wildlife natural conservation areas in the province; undertaking the work in relation to biodiversity protection; and organizing and coordinating wetland protection throughout the province.

  6)      Office of the Forest Fire Prevention Command of Sichuan Province 

  The Office of the Forest Fire Prevention Command of Sichuan Province shall be responsible for: drafting provincial work plans for forest fire prevention; directing and coordinating forest fire prevention and fighting throughout the province; implementing fire prevention and fighting measures in key forest areas; improving the radio communication system and the internet system for forest fire prevention; collecting and releasing information about forest fire in the province; and undertaking the specific work of the Forest Fire Prevention Command of Sichuan Province.

  7)      Office for Development Planning and Funds Administration (Office for Forestry Industry) 

  The Office for Development Planning and Funds Administration shall be responsible for: drafting provincial development plans for forestry and ecological improvement,as well as supervising the implementation thereof; organizing and directing the establishment and implementation of a ecological compensation mechanism for forestry and ecological improvement throughout the province; formulating forestry-related construction projects and financial budgets and final accounts,as well as providing budgetary advices concerning special provincial financial funds for forestry; administering and supervising provincial forestry funds; reviewing and approving major forestry-related construction projects,providing advices for forestry fixed asset investment scales of the province,and drawing up annual production plans for forestry and ecological improvement; regulating forest resource assets and state-owned assets of the Bureau and units directly subordinate to it; the work in relation to statistics and information; and undertaking relevant responsibilities to direct forestry development of the province.

  8)      Office for Science and Technology  

  The Office for Science and Technology shall be responsible for: directing provincial forestry scientific and technological researches; drafting provincial development plans and other plans in relation to forestry science and technology; undertaking the work in relation to reporting major forestry scientific and technological development projects for approval; undertaking the work in relation to forestry sci-tech system reforms,the innovation system improvement and the promotion and application of results thereof; undertaking the forestry standardization,the forestry technology supervision,the supervision over the quality of forestry products and the protection and administration of new plant varieties; administering and supervising the work in relation to forestry botanic species resources throughout the province and the safety of genetically modified forestry organisms; and directing and coordinating the implementation of external sci-tech exchange and coordination projects.

  9)      Office for International Cooperation (Office for Hong Kong,Macau and Taiwan-related Affairs)

  The Office for International Cooperation shall be responsible for: undertaking the work in relation to forestry cooperation and exchange at home and abroad; participating in the work in relation to introducing and utilizing foreign funds and advanced science and technology and looking for economic and technological aid outside the province and the country; and undertaking the forestry affairs in relation to Hong Kong and Macau special administrative regions and the Taiwan district.

  10) Office for Complaint Handling

  The Office for Complaint Handling shall be responsible for: receiving and handling letters and visits from the mass,statistics,filing,etc.; studying and analyzing the complaint handling work in relation to forestry of the province; supervising the handling of major complaint cases; assisting in handling mass emergencies; and supervising and examining the forestry complaint handling work of the province.

  11) Personnel Office

  The Personnel Office shall be responsible for: undertaking the work in relation to personnel and institutional structures of the Bureau and units directly subordinate to it; directing forestry talent training and education development plans of the province,as well as organizing the implementation thereof; and directing forestry talent cultivation of the province.

  12) Office for Affairs of Retired Staff

  The Office for Affairs of Retired Staff shall be responsible for undertaking the work in relation to retired staff of the Bureau and directing such work of directly subordinate units.

  The Party Committee of the Bureau shall be responsible for the work in relation to Party-and-mass relationship in the Bureau and its directly subordinate institutions. Its work organs are to be set up by the Party Group of the Bureau in accordance with provisions by the CPC Sichuan Provincial Committee.  

  IV.  Personnel and Number of Leaders

  The Forestry Bureau of Sichuan Province is to have an administrative staff of 86,including 1 Director and 4 Deputy Directors. The Party Secretary to the Bureau is to be appointed in accordance with relevant requirements of the CPC Sichuan Provincial Committee. The Bureau is also to have 1 full-time superintendent and 1 general engineer for the Forest Fire Prevention Command of Sichuan Province,as well as 13 officials of leading roles of divisions or equivalents (including one full-time deputy secretary for the Party Committee of the Bureau or director of the Party Office of the Bureau) and 16 officials of assisting roles of divisions or equivalents.

  The Bureau is to have 4 officials under separate administration transferred from military forces.

  The Bureau is to have 4 positions for special personnel of disciplinary inspection and supervision delegated by the Sichuan Provincial Commission of Disciplinary Inspection and the Supervisory Department of Sichuan Province,including one Head of the Disciplinary Inspection Team (Special Commissioner for Supervision) and one Director of Supervision (Deputy Head of the Disciplinary Inspection Team). All the above personnel shall be subject to the administration provided in the Circular of the General Office of the CPC Sichuan Provincial Committee and the General Office of Sichuan Provincial Government on Transmitting the'Opinion of Sichuan Provincial Commission of Disciplinary Inspection,Organization Department of the CPC Sichuan Provincial Committee,the Office of Institutional Establishment of Sichuan Province and Supervisory Department of Sichuan Province Concerning the Implementation of Centralized Administration on Delegated Organs of Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province'(ChuanWeiBan [2005]No. 30).

  The Bureau is also to have a maximum support staff of 2.  

  V.     Miscellaneous

  1)            The Forestry Bureau shall be responsible for the administration of the Forest Public Security Bureau of Sichuan Province. As an administrative institution (at the division level) directly subordinate to the Forestry Bureau,the Forest Public Security Bureau of Sichuan Province is under double-leadership of the Forestry Bureau and the Public Security Bureau of the province. In terms of the party and governmental work,the Forest Public Security Bureau is mainly subject to the administration of the Forestry Bureau,while it is mainly subject to the administration of the Public Security Bureau when public security affairs are involved; and

  2)            Constitution,functions and staff structures of the subordinate units shall be prescribed separately.

  VI.  Supplementary Provisions

  These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
