Recently, the General Office of Sichuan
Provincial People's Government issued the Management Measures for Power and
Responsibility Listsof Sichuan Province, which has shed more light on how to
prepare, adjust, publish, implement and supervise the power and responsibility
lists of thedepartments that can execute power and seen to it that the
administrative power is executed transparently and according to law.
As per the document, the general offices of
the people's governments at all levels should work together with relevant
departments to strengthen supervision on the implementation of the power and
responsibility list mechanism to ensure that the administrative power is
executed transparently and according to law; the people's governments at all
levels should determine respective departmentsmanaging the power and
responsibility lists to coordinate the construction of the power and
responsibility list mechanism and spearhead the strategic preparation and
dynamic adjustment of the power and responsibility lists; the judicial
departments at all levels should take charge of reviewing the legitimacy of the
power and responsibility items, and participate in the approval of the
strategic preparation and dynamic adjustment of the power and responsibility
lists; departments that can execute power should take charge of the
preparation, publishing, and procedure-based adjustment of power and
responsibility items on power and responsibility lists at respective levels,
and take charge of the management, maintenance and update of respective power
and responsibility items on the integrated government service platforms;
government service departments at all levels should include all necessary application-specific
administrative power items into the service scope for government service
halls;departments in charge of managing the integrated government service
platforms should take charge of the construction, management and update of
relevant government service platforms, and guide departments that can execute
power to allocate basic power and responsibility elements and operation
procedures on the integrated government service platforms; all the places in
the province should take into consideration departmental and functional setup
and specific management work for power and responsibility lists to ensure clear
assignment of responsibilities of relevant departments and complete the
coordinated working mechanism for power and responsibility list management.
Moreover, as required by the document, a power
and responsibility list should consist of administrative power items, basic
elements, and corresponding responsibilities.Specifically, the administrative
power items should be specified in the form of administrative power list, and
be published. Departments that can execute power at all levels should follow
the principle that powers and responsibilities correspond with each other and
conform with relevant laws, regulations, rules of all departments of determining
responsibilities, managing organizations and specific preparation and relevant
administrative regulation documents. As a result, the corresponding
responsibilities of each administrative power item which mainly include responsibility
subjects, responsibility items, accountability basis, accountability situations
and exemption situations, and supervision forms can be sorted out, made clear
and defined.
The general offices of the people's
governments at all levels should work together with organizations in charge of
managing power and responsibility lists, judicial departments and other
departments (organizations) to enhance dynamic adjustment of the power and
responsibility lists and strengthen supervision on their implementation, and
include the dynamic adjustment work into the examined content for the
performance goal of administration based on rule of law. In the meanwhile, the
departments that can execute power should strengthen the management of power
and responsibility lists, develop and complete the accountability mechanism,
carry out supervision on respective work related to the implementation of power
and responsibility lists throughout the process, and guide and supervise the
work related to power and responsibility lists of subordinate departments.
