| Preliminary Examination for Sino-foreign-run Educational Programs for Academic Qualifications At or Above Undergraduate Level |

◆Basic information

◆Required documents
1. An application report for Sino-foreign-run educational programs, which shall include: the names of the Chinese and foreign cooperators, the name of the proposed educational program, educational targets, size of the proposed program, level and form of education to be offered, conditions for offering education, internal management system, sources of funding and capital management and use, etc.
2. An application form for Sino-foreign-run educational programs (available at the window for the department of education at the Administrative Services Center of the People’s Government of Sichuan Province or at http://www.scedu.net).
3. Agreements for cooperation which shall contain: the name and domicile of the proposed educational program, the names, domicile and legal representatives of the Chinese and foreign cooperators, educational objectives and targets, the content and duration of cooperation, contributed amount of all parties, means of contribution, deadline for capital payment, rights and obligations, ways of dispute settlement, etc.;
4. The Chinese and foreign cooperators’ certifications of legal person status;
5. Documents issued by Chinese embassies and consulates in foreign countries certifying relevant overseas educational institutions;
6. If there is any contribution of assets or capital, certifications of capital verification;
7. If there is any donated assets, donation agreements for any assets donated and relevant valid verifying documents;
8. If the overseas educational institution has established any Sino-foreign-run educational institutions or programs within the territory of the PRC, assessment reports on such institutions or programs issued by the original approval authorities or private intermediary agencies under the commission of the original approval authorities;
9. Real samples of certificates of academic qualifications and certificates of academic degrees; and

◆Conditions for approval
1. The Chinese and foreign cooperators shall be both educational institutions and have legal person status;
2. The level and category of education of the Sino-foreign-run educational program shall correspond to those of the Chinese educational institution and the foreign educational institution, and the proposed educational program shall generally match the existing or similar majors and courses in the Chinese educational institution. Where the proposed educational program involves new majors or courses, the Chinese educational institution shall have the faculty, equipment and facilities for running such majors or courses.
◆Legal basis
1. Article 61 of the Regulations of the People’s Republic of China on Sino-foreign-run Educational Programs (Order No.372 of the State Council, March 1, 2003) provides that: “Competent authorities for education of the State Council shall make specific measures for examination and approval and administration of educational programs jointly run and operated by foreign educational institutions and Chinese educational institutions within the territory of the PRC and providing education mainly to Chinese citizens, for offering education for academic qualifications, tutoring self-taught students for examinations, supplementary teaching of school courses or pre-school education. Competent authorities for labor of the State Council shall make specific measures for examination and approval and administration of educational programs jointly run and operated by foreign educational institutions and Chinese educational institutions within the territory of the PRC and providing education mainly to Chinese citizens, for offering training of vocational skills.”
2. Article 36 of the Implementing Measures of the Regulations of the People’s Republic of China on Sino-foreign-run Educational Programs (Order No.20 of the Ministry of Education, June 2, 2004) provides that: “An application for establishing a Sino-foreign-run educational program for academic qualifications of or above undergraduate level shall be subject to approval of competent authorities for education of the State Council, after competent authorities for education of the people’s governments at the province, autonomous region or municipality where the proposed program is located give comments thereon. An application for establishing a Sino-foreign-run educational program offering specialized higher education, higher education for non-academic qualifications or senior secondary education, or tutoring self-taught students for examinations or supplementary teaching of school courses or pre-school education, shall be submitted to competent authorities for education of the State Council for the purpose of filing, after being approved by competent authorities for education of the people’s governments at the province, autonomous region or municipality where the proposed program is located. ”
