In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Printing and Releasing'the Plan of the Institutional Reform of Sichuan Provincial Government' and'the Opinion on the Implementation of the Plan of the Institutional Reform of Sichuan Provincial Government',the Sichuan Provincial Department of Culture,which is a composing department of Sichuan Provincial Government （referred to as the"SPDC"）,is hereby established.

　　Ⅰ. Adjustment of Functions

　　1）      Canceling such items of administrative approval as released by the provincial government;

　　2）      Assigning functions in relation to film release,film screening and collection and management of special funds for films to Sichuan Bureau of Radio,Film and Television;

　　3）      Assigning administration functions in relation to wholesale,retail,rental,screening and import of audio and video products to Sichuan Press and Publication Agency;

　　4）      Assigning function of organizing grand-scale external cultural exchange activities from Information Office of the Provincial Government to Sichuan Provincial Department of Culture;

　　5）      Assigning functions of administrating animations （excluding animation in film and television and on-line audio-visual animation programs） from Sichuan Bureau of Radio,Film and Television to Sichuan Provincial Department of Culture;

　　6）      Assigning functions of administrating animations and on-line games （excluding on-line publishing pre-approval of on-line games） as well as on-line game-related industry plans,industry bases,project construction,trade fairs and market regulations from Sichuan Press and Publication Agency to Sichuan Provincial Department of Culture;

　　7）      Increasing functions of formulating development plans,policies and draft local rules and regulations for cultural market as well as guiding comprehensive law enforcement in cultural market;

　　8）      Increasing function of regulating non-state establishments engaging in performing practices; and

　　9）      Increasing functions of strengthening public cultural services,guiding grass-roots cultural development and preserving intangible cultural heritages.

　　Ⅱ. Major Functions

　　1）      To formulate policies for the province's culture and art,take charge of the drafting of local cultural and artistic rules and governmental regulations and ensure the implementation thereof;

　　2）      To formulate development plans for cultural and artistic undertakings and culture and art industry,guide and coordinate the development of culture and art industry,promote external exchanges and cooperation of culture industry,push forward institutional restructure and reform of mechanism in the fields of culture and art;

　　3）      To provide guidance on and administrate culture and art undertakings,guide artistic creation and production,support representative,demonstrative and experimental cultural and artistic works,promote the development of art undertaking in various forms,administrate major culture and art activities at provincial level;

　　4）      To promote public cultural services in the fields of culture and art,lay out and guide the production of public cultural products,provide guidance on the construction of key cultural facilities at provincial level and the construction of grass-roots cultural facilities;

　　5）      To formulate plans for the preservation of intangible cultural heritages,be responsible for the drafting of relevant local rules and regulations,organize the implementation of affairs in relation to preserving intangible cultural heritages and passing on and popularizing fine and outstanding national culture;

　　6）      To guide and administrate social and cultural undertakings,provide guidance on the construction of libraries,cultural centers （stations） and the development of grass-roots culture;

　　7）      To formulate development plans for cultural market,provide guidance on the law enforcement work in cultural market,take charge of supervising cultural and artistic business activities,provide guidance on regulating non-state establishments engaging in performing practices;

　　8）      To be in charge of pre-approval work of network transmission of literary and artistic products,be responsible for the administration of operation licenses issued to Internet cafes and business premises providing Internet services,carry out supervision over on-line game services （excluding on-line publishing pre-approval of on-line games）;

　　9）      To formulate development plans for animations and game industries and ensure the implementation thereof,guide and coordinate the development of animation and game industries;

　　10）   To formulate development plans for cultural science and technology and ensure the implementation thereof,promote information development of cultural science and technology and the development of artistic scientific research,provide guidance on artistic occupational education in culture sector;

　　11）   To provide guidance on and administrate external cultural exchanges and cultural publicity and exchanges and publicity work with Hong Kong,Macao and Taiwan,sign external cultural cooperation agreements on behalf of Sichuan Province,organize the implementation of grand-scale external cultural exchange activities;

　　12）   To administrate cultural relics undertakings of Sichuan Province;

　　13）   To handle relevant items of administrative approval as released by the provincial government; and

　　14）   To undertake other tasks assigned by the provincial government.

　　Ⅲ. Constitution of the Bureau

　　On the basis of the above functions,10 internal offices are set up in the Bureau.

　　1）      General Office （Division of Policies and Rules）

　　The General Office shall coordinate comprehensively administration work of the Department and its subordinate agencies. The Office shall push forward the implementation of major items and events. The Office shall formulate internal rules and regulations and annual work plans of the Department. The Office shall be responsible for affairs in relation to official papers and telegrams,conference organization,confidential documentation,files,information,publicity,confidentiality,letters and visits form the public,comprehensive administration and emergency treatment. The Office shall organize to handle motions from deputies to the NPC （National People's Congress） and members of the NPPCC （the Chinese people's Political Consultative Conference）. The Office shall administrate executive affairs of the Department. The Office shall organize the drafting of mid and long-term development plans and local rules and regulations for culture and art. The Office shall carry out supervision over administrative law enforcement. The Office shall undertake matters in relation to administrative review cases and other administrative rules.

　　2）      Art Division

　　The Art Division shall organize to formulate development plans for literature and art industries. The Division shall support representative,demonstrative and experimental cultural and artistic works. The Division shall support outstanding literary and artistic works reflecting socialist core value system and key art schools and troupes representing provincial and above level and national characteristics. The Division shall provide guidance on artistic creation and production. The Division shall promote the art development in various forms. The Division shall organize,guide and coordinate provincial artistic performances and exhibitions as well as major artistic activities.

　　3）      Administration Division of Cultural Market （Division of Administrative Approval）

　　The Administration Division of Cultural Market shall formulate development plans and policies for cultural market and ensure the implementation thereof. The Division shall provide guidance on comprehensive law enforcement in culture market. The Division shall conduct supervision over business activities in cultural field. The Division shall regulate artistic performances and exhibitions,cultural recreations,cultural and artistic works and art training markets. The Division shall undertake work in relation to music and fine arts recreation,Internet animation （excluding on-line audio-visual animation programs）,on-line shows （programs）,on-line performing practices and pre-approval of mobile music. The Division shall coordinate industry plans,industry bases,project construction,trade fairs and market supervision over animation and game industries. The Division shall conduct content inspection of imported on-line artistic products in application link. The Division shall be responsible for the administration of operation licenses issued to Internet cafes and business premises providing Internet services. The Division shall carry out content inspection of electronic recreational machines in production,import and management links. The Division shall conduct supervision over on-line game services （excluding on-line publishing pre-approval of on-line games）. The Division shall provide guidance on regulating non-state establishments engaging in performing practices. The Division shall handle relevant items of administrative approval of the Department. The Division shall undertake specific work of leading body office of cultural market administration.

　　4）      Division of Culture Industry

　　The Division of Culture Industry shall formulate development plans for culture industry. The Division shall support and promote the construction and development of culture industry. The Division shall promote informatization development of culture industry and external exchanges and cooperation of culture industry. The Division shall provide guidance on and push forward the exploration and implementation of major culture industrial projects. The Division shall guide the construction of culture industrial bases and the construction of culture industrial complexes with regional features.

　　5）      Division of Social Culture

　　The Division of Social Culture shall formulate development plans for social culture undertakings. The Division shall provide guidance on the development of public cultural service system. The Division shall guide work in relation to mass culture,ethnic minority culture,juvenile culture and culture of the aged. The Division shall provide guidance on the popularization of culture and art. The Division shall guide the construction of libraries and culture centers （stations）. The Division shall provide guidance on the resource sharing projects of culture information and the preservation work of ancient books and classic literature. The Division shall guide mass cultural activities at grass-roots level. The Division shall provide guidance on the construction of cultural recreation rooms and community cultural centers in the villages.

　　6）      Preservation Division of Intangible Cultural Heritages （Division of Education,Science and Technology）

　　The Preservation Division of Intangible Cultural Heritages shall formulate policies for the preservation of intangible cultural heritages. The Division shall formulate preservation plans for representative items of intangible cultural heritages at provincial level. The Division shall organize to carry out preservation work of intangible cultural heritages. The Division shall organize to undertake reporting and accrediting work of representative items and heirs of intangible cultural heritages at national and provincial level. The Division shall provide guidance on work in preservation zones with distinctive culture. The Division shall guide and implement affairs in relation to passing on,exploiting and popularizing of outstanding national cultural heritages. The Division shall be responsible for the plans,construction and administration of museums and training institutes of intangible cultural heritages. The Division shall formulate development plans for cultural and artistic education and cultural science and technology. The Division shall guide and coordinate breakthroughs and major results promotion of key cultural and artistic scientific research projects. The Division shall promote informatization construction of cultural science and technology. The Division shall provide guidance on artistic occupational education in culture sector.

　　7）      Liaison Division of External Cultural Affairs （Office for Cultural Affairs with Hong Kong,Macao and Taiwan）

　　The Liaison Division of External Cultural Affairs shall formulate policies for external exchanges and exchanges with Hong Kong SAR,Macao SAR and Taiwan. The Division shall provide guidance on and administrate affairs in relation to external cultural exchange and publicity as well as exchanges and publicity with Hong Kong,Macao and Taiwan. The Division shall be responsible for overall planning,coordinating and organizing the implementation of grand-scale external cultural exchange activities. The Division shall undertake matters in relation to signing overseas cultural cooperation agreements. The Division shall organize the implementation of inter-governmental annual cultural exchange plans.

　　8）      Finance Division

　　The Finance Division shall work out mid and long-term plans for key projects of cultural facilities. The Division shall manage funds for culture administration. The Division shall take charge of financial work of the Department. The Division shall guide and supervise affairs in relation to finance,infrastructure construction,state-owned assets and government procurement of subordinate agencies. The Division shall be responsible for statistical work of the culture system. The Division shall take charge of financial audit work of subordinate agencies of the Department. The Division shall provide guidance on the key cultural construction and the construction of grass-roots cultural facilities.

　　9）      Personnel Division

　　The Personnel Division shall be responsible for matters in relation to personnel administration,education and training,institutional organization,labor and payment of the Department and its subordinate agencies. The Division shall formulate and organize to implement personnel development plans for culture and art industry. The Division shall undertake qualification accrediting work of professional technical personnel within the culture system. The Division shall provide guidance on and push forward systematic reform of provincial cultural system. The Division shall guide institutional restructure and reform of mechanism in the fields of cultural and art. The Division shall,together with relevant departments,provide guidance on the work in relation to vocational qualification administration of employees in cultural and artistic sector throughout the province.

　　10）   Division of Affairs of Retired Staff

　　The Division of Affairs of Retired Staff shall be responsible for affairs in relation to retired staff and provide guidance on the work in relation to retired staff in the line of directly subordinate agencies throughout the province.

　　The Party Committee of the Department shall be responsible for work in relation to Party-and-mass relationship in the Department and subordinate agencies. Its work organs are to be set up by the Party Group of the Department in accordance with provisions by the CPC Sichuan Provincial Committee.

　　Ⅳ. Personnel and Number of Leaders

　　The Sichuan Provincial Department of Culture is to have 57 staff,including one Director and 3 Deputy Directors. Party secretaries are to be appointed in accordance with provisions by the CPC Sichuan Provincial Committee. The Department is to have 11 officials of leading roles of divisions or equivalents （including one full-time deputy secretary for the Party Committee of the Department or director of the Party Office of the Department） and 12 officials of assisting roles of divisions or equivalents.

　　The Department is to have 1 official under separate administration transferred from military forces.

　　The Department is to have 3 positions for special personnel of disciplinary inspection and supervision delegated by Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province,including one Head of the Disciplinary Inspection Team （Special Commissioner for Supervision） and one Director of Supervision （Deputy Head of the Disciplinary Inspection Team）. All the above personnel shall be subject to the administration provided in the Circular of the General Office of the CPC Sichuan Provincial Committee and the General Office of Sichuan Provincial Government on Transmitting the'Opinion of Sichuan Provincial Commission of Disciplinary Inspection,Organization Department of the CPC Sichuan Provincial Committee,the Office of Institutional Establishment of Sichuan Province and Supervisory Department of Sichuan Province Concerning the Implementation of Centralized Administration on Delegated Organs of Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province' （ChuanWeiBan [2005]No. 30）.

　　The Department is to have one service personnel for retired staff.

　　Ⅴ. Miscellaneous

　　1）      Division of Functions of Animations and On-line Game Administration

　　Sichuan Provincial Department of Culture shall take charge of animation and on-line game-related industry plans,industry bases,project construction,trade fairs and market regulations. Bureau of Radio,Film and Television of Sichuan Province shall be responsible for the administration of film and television animations and on-line audio-visual animation programs. Sichuan Press and Publication Agency shall be in charge of administrating animations in the publication link and undertaking function of pre-approving on-line publication of games.

　　2）      Provisions for the establishment,functions,and institutional organization of subordinates shall be formulated otherwise.

　　Ⅵ. Supplementary Provisions

　　These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
