Sichuan Provincial Bureau of Work Safety Supervision

  In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Printing and Releasing ‘the Plan of the Institutional Reform of Sichuan Provincial Government'and ‘the Opinion on the Implementation of the Plan of the Institutional Reform of Sichuan Provincial Government'(CWF〔2009〕No.24),the Sichuan Provincial Bureau of Work Safety Supervision ("SPBWSS” for short),which is directly under Sichuan Provincial Government,is hereby established. Also in the names of the"Sichuan Provincial Office of Work Safety Commission” and the"Sichuan Provincial Office of Coal Mine Work Safety Supervision and Administration”,the Sichuan Provincial Bureau of Work Safety Supervision works under one roof with the Sichuan Coal Mine Safety Bureau (“SCMSB” for short).

  I.       Adjustment of Functions

  1)      Canceling such items of administrative approval as released by the provincial government;

  2)      Transferring the function of examining qualifications of and issuing relevant certificates to coal mine managers and special operators (including personnel operating special equipments in coal mines) from Sichuan CMSB to Sichuan WSA;

  3)      Transferring the function of coal mine gas level appraisal from the Sichuan Province Economic Commission to Sichuan WSA;

  4)      Reinforcing the comprehensive supervision,administration,guidance and coordination for work safety in the province; and

  5)      Reinforcing the work safety-related supervision and examination on relevant provincial departments and all governments below the provincial level. 

  II.    Major functions

  1)      To implement state laws,regulations and policies in relation to work safety; draft provincial work safety-related regulations and rules for the province; and draft work safety-related policies,plans,trade standards and rules for the province and organize the implementation thereof;

  2)      To shoulder the responsibility of comprehensive supervision and administration on work safety on behalf of the provincial government; serve the function of comprehensive supervision and administration according to law; guide,coordinate,supervise and examine work safety of relevant provincial departments and all governments below the provincial level; analyze and predict the provincial work safety situation on a regular basis; release information on work safety throughout the province; help solve major work safety problems; supervise,appraise and report the execution of work safety indicators; supervise and guide the implementation of the work safety responsibility system; and supervise accident investigations and responsibility acknowledgement;

  3)      To shoulder the work safety supervision and administration responsibility for the mining industry; supervise and examine,according to law,as well as the principles of different levels and governed areas,whether mining units operate in compliance with relevant laws and regulations,whether they meet the safety conditions and whether relevant equipments (excluding special equipments),materials and labor protection articles are provided and managed properly; supervise and examine the monitoring of significant hazardous sources and the checking and preventing of potential accidents; uncover and punish mining units which do not meet the work safety requirements; and assist the State Administration of Work Safety in supervising and administering work safety of the mining and trading enterprises in Sichuan Province on behalf of the central government;

  4)      To take on the responsibility of setting work safety standards for production and business operation entities engaged in non-coal mines,hazardous chemicals,non-pharmaceutical precursor chemicals,firecrackers and fireworks,etc.; organize the implementation of the aforesaid work safety standards according to law; and take charge of the comprehensive supervision and administration on hazardous chemicals and firecrackers and fireworks;

  5)      To assume the responsibility of the occupational health conditions in mining sites (excluding coal mining sites); take charge of issuing and administering occupational health and safety certificates; and investigate into and deal with occupational injury accidents and illegal or irregular acts;

  6)      To organize general and special work safety examinations on behalf of the provincial government,as well as investigating into and settling accidents according to law and authorization from the provincial government; and organize,guide and coordinate emergency rescues in relation to work safety,comprehensively administer the accident-related work throughout the province,and conduct statistic analyses on administrative law enforcement in relation to work safety;

  7)      To supervise and examine whether the safety facilities are designed,built and put into use at the same time with the main work for any new,changed or expanded mining project within the scope of functions and duties;

  8)      To assume the responsibility of supervising and administering work safety of all coal mines throughout the province,supervising and examining whether the mining and trading enterprises operate in compliance with work safety-related laws and regulations,and uncover and punish acts against the aforesaid laws and regulations according to law; organize and give guidance in special safety improvement campaigns,safety standard unification and safety-related science and technology development activities of coal mining enterprises; participate in adjusting and shutting down coal mines,as well as investigating into and dealing with coal mine accidents; and,together with other relevant authorities,examine and approve projects concerning coal mine safety technology improvement and comprehensive gas treatment and use,and identify gas levels of coal mines;

  9)      To examine and supervise work safety-related qualifications of persons-in-charge and work safety-related executive personnel of mining units; conduct appraisal and operating qualification certificate-issuing for special operators (including personnel operating special equipments in coal mines); and supervise and examine work safety and employee safety training activities in mining units;

  10)  To direct and coordinate in work safety tests and inspections throughout the province; supervise and administer intermediate agencies involving work safety and safety appraisals conducted by them; and supervise and direct in the administration of registered safety engineer licensing examinations and the relevant registration work;

  11)  To organize,direct,coordinate and supervise work safety-related administrative law enforcement throughout the province;

  12)  To draft work safety science and technology plans for the province; and direct and coordinate in major researches and extensions on work safety science and technology;

  13)  To organize external exchange and cooperation activities in relation to work safety;

  14)  To undertake the specific work of the Sichuan Province Work Safety Commission;

  15)  To undertake relevant administrative approval matters released by the provincial government; and

  16)  To undertake other tasks assigned by the provincial government.

  III.Constitution of the Administration

  On the basis of the functions above,9 internal offices are set up in the Work Safety Supervision Bureau of Sichuan Province.

  1)      General Office

  The General Office shall be responsible for: drafting various work rules for the Administration as a whole; the administration of documents,information,confidentiality,files,motions,proposals,complaint letters,staff performance,etc.; financial affairs of the Administration,management and audit of its state-owned assets and guiding and supervising financial affairs and asset management of the institutions subordinate to the Administration; organizing external exchange and cooperation activities in relation to work safety; and undertaking the specific work of the Sichuan Provincial Office of Work Safety Commission. 

  2)      Office for Policies and Regulations (Administration Approval Office)

  The Office for Policies and Rules shall be responsible for: drafting local regulations and governmental rules in relation to work safety for the province; drafting local comprehensive work safety rules,norms and standards for the mining industry; drafting major policies of work safety; releasing work safety information for the province; undertaking work safety law enforcement supervision,administrative review and work in relation to responding to actions of administrative review; organizing and guiding press releases to promote work safety; drafting important documents and reports; examining and approving legality of relevant regulatory documents to be released by the Administration; and undertaking relevant administrative approval matters.

  3)      Office for Planning and Technology (Office for Coal Mine Safety Supervision and Administration)

  The Office for Planning and Technology shall be responsible for: drafting plans concerning work safety and relevant technologies; directing and coordinating in significant work safety scientific and technological researches and promote activities; work safety informatization; the administration of fixed asset investment projects within the prescribed authority; supervising and administering work safety intermediate agencies,tests and inspections,safety appraisals,labor protection articles and safety signs; supervising and examining whether the safety facilities are designed,built and put into use at the same time with the main work for any new,changed or expanded mining project within the scope of functions and duties; the work in relation to the provincial work safety expert team; supervising and administering work safety of coal mines throughout the province,supervising and examining the implementation of work safety laws and regulations by coal mining enterprises,and uncovering and punishing illegal acts against work safety laws according to law; organizing and giving guidance in special safety improvement campaigns,safety standard unification and safety-related science and technology development activities of coal mining enterprises; participating in adjusting and shutting down coal mines,as well as investigating into and dealing with coal mine accidents; and,together with other relevant authorities,examining and approving projects concerning coal mine safety technology improvement and comprehensive gas treatment and use,and identifying gas levels of coal mines.

  4)      Office for Work Safety Emergency Rescue (Office for Dispatching and Statistics)

  The Office for Work Safety Emergency Rescue shall be responsible for: drafting local rules,norms and standards in relation to work safety emergency rescue and relevant statistics; directing building the provincial work safety emergency rescue system; organizing the planning of work safety emergency rescue plans and relevant drills; directing and coordinating the work of work safety emergency rescue; providing the provincial work safety control appraisal indicators; comprehensively administering the provincial work of safety work and occupational injury statistics; assigning personnel to watch for possible work safety emergencies and deal with emergencies reported; analyzing and predicting the work safety situation and particularly significant accident risks,and releasing relevant warnings.

  5)      Office One for Safety Supervision and Administration 

  The Office One for Safety Supervision and Administration shall be responsible for: supervising and examining,according to law,whether production and business operation entities involving non-coal mining (including geological exploitation),fossil oil (excluding refined and product oil channels),natural gas,metallurgy,nonferrous metals and construction materials operate in compliance with work safety laws and regulations,whether they meet the required work safety conditions and whether their equipments and facilities are safe enough; supervising and examining whether the safety facilities are designed,built and put into use at the same time with the main work for any new,changed or expanded construction project within the scope of functions and duties; examining the design of safety facilities of relevant construction projects and re-checking the entire project before it is called"completed and accepted”; the work safety admittance administration,expert commentation and on-site checks on relevant enterprises; guiding and supervising the relevant safety standardization and the shutting down of non-coal mines which do not meet the prescribed work safety conditions; and participating in investigations into and treatment of major accidents in the relevant industries,as well as the relevant rescue work.

  6)      Office Two for Safety Supervision and Administration

  The Office Two for Safety Supervision and Administration shall be responsible for: supervising and examining,according to law,whether production and business operation entities involving machinery,the light industry,textile,tobacco,commerce & trading and other relevant industries operate in compliance with work safety laws and regulations,whether they meet the required work safety conditions and whether their equipments and facilities are safe enough; supervising and examining whether the safety facilities are designed,built and put into use at the same time with the main work for any new,changed or expanded construction project within the scope of functions and duties; examining the design of safety facilities of relevant construction projects and re-checking the entire project before it is called"completed and accepted”; directing,coordinating and supervising the safety supervision and administration of industries and sectors (highway,water transportation,railway,civil aviation,construction,water conservancy,postal service,telecom,forestry,the military industry,tourism,etc.) with their own work safety authorities; directing and coordinating relevant departments to organize special inspections and rectifications in relation to work safety; and participating in investigations into and treatment of major accidents in the relevant industries,as well as the relevant rescue work.

  7)      Office Three for Safety Supervision and Administration

  The Office Three for Safety Supervision and Administration shall be responsible for: supervising and examining,according to law,the work safety conditions in production and business operation entities engaged in chemicals (including petrochemicals),medicine,hazardous chemicals and firecrackers and fireworks; the work safety admittance administration,expert commentation and on-site checks on relevant enterprises; uncovering and punishing production and business operation entities which do not meet the prescribed work safety conditions; the comprehensive safety supervision and administration of hazardous chemicals,and organizing and guiding the registration of hazardous chemicals; the supervision and administration on production and business operation of non-pharmaceutical precursor chemicals; supervising and examining whether the safety facilities are designed,built and put into use at the same time with the main work for any new,changed or expanded construction project within the scope of functions and duties; examining the design of safety facilities of relevant construction projects and re-checking the entire project before it is called"completed and accepted”; guiding and supervising the relevant safety standardization; and participating in investigations into and treatment of major accidents in the relevant industries,as well as the relevant rescue work.

  8)      Office for Occupational Health and Safety Supervision and Administration 

  The Office for Occupational Health and Safety Supervision and Administration shall be responsible for: supervising and examining,according to law,the occupational health conditions in mining operation sites (excluding coal mining operation sites); uncovering and administering punishments for occupational injury accidents and illegal and irregular acts; issuing and administering relevant occupational health and safety certificates; supervising and examining occupational health and safety trainings by mining and trading enterprises; directing the occupational hazard reporting work; and participating in investigations into and treatment of occupational injury accidents,as well as the relevant rescue work.  

  9)      Office for Personnel & Training (Office for Affairs of Retired Staff)

  The Office for Personnel & Training shall be responsible for: the personnel administration,team building,labor and wages,institutional constitution and other administration work of the Administration and institutions subordinate to it; supervising and directing in the administration of registered safety engineer licensing examinations and the relevant registration work; organizing,supervising and administering the appraisal and certificate-issuance of relevant safety qualifications; directing the safety trainings throughout the province; supervising and examining safety trainings by mining and trading enterprises; and the retired staff affairs of the Administration and institutions subordinate to it. 

  The Party Committee of the Administration shall be responsible for work in relation to Party-and-mass relationship in the Administration and subordinate institutions. Its work organs are to be set up by the Party Group of the Administration in accordance with provisions by the CPC Sichuan Provincial Committee.  

  The General Office,the Office for Planning and Technology (Office for Coal Mine Safety Supervision and Administration),the Office for Personnel & Training (Office for Affairs of Retired Staff),the Party Committee of the Administration and the Discipline Inspection and Supervision Office are shared by the Administration and the Sichuan Coal Mine Safety Bureau. And the specific work for the said offices is to be coordinated and determined jointly by the Administration and the Sichuan Coal Mine Safety Bureau.  

  The support services for the Administration are to be provided by the Service Center of the Sichuan Coal Mine Safety Bureau.

  IV.  Personnel and Number of Leaders

  The Work Safety Supervision Bureau of Sichuan Province is to have an administrative staff of 54,including 1 Director (concurrently the Chief for the Sichuan Provincial Office of Work Safety Commission and the Director for the Sichuan Coal Mine Safety Bureau) and 3 Deputy Directors (one of them concurrently being the Chief for the Sichuan Provincial Office of Coal Mine Work Safety Supervision and Administration). The Party Secretary and Discipline Inspection Head of the Administration are to be appointed in accordance with relevant requirements. The Administration is also to have 7 officials of leading roles of divisions or equivalents (including one full-time deputy secretary for the Party Committee of the Administration or director of the Party Office of the Administration) and 8 officials of assisting roles of divisions or equivalents; and 4 work safety special inspectors (2 of leading roles of divisions and the other 2 of assisting roles of divisions or equivalents).

  The Administration is to have 2 officials under separate administration transferred from military forces.

  The Administration is also to have a maximum support staff of 5.  

  V.     Miscellaneous

  1)            Other matters concerning the working under one roof of the Administration and the Sichuan Coal Mine Safety Bureau shall be dealt with according to the Circular of the General Office for Sichuan Provincial People’s Government on the Work Safety Supervision Bureau of Sichuan Province and the Sichuan Coal Mine Safety Bureau Working Under One Roof (CBF〔2003〕No.3).

  2)            Division of Occupational Health Supervision and Administration Function                                    

  The Administration shall take charge of: supervising and examining the occupational health conditions in operation sites (excluding coal mining operation sites); issuing and administering occupational health and safety certificates; and uncovering and imposing punishments for occupational injury accidents and acts against relevant laws and regulations. And the provincial health office shall take charge of: drafting local regulations,rules and standards in relation to occupational health; setting norms for prevention of,protection from,examination and treatment of occupational diseases; and defining qualifications of occupational health technology and service agencies,and appraising occupational health conditions and toxicity of chemicals. A well-coordinated function division mechanism shall be established between the Administration and the provincial health office,both of which shall work together and excellently accomplish the relevant work.

  3)  Constitution,functions and staff structures of the institutions subordinate to the Administration shall be separately prescribed.

  VI.  Supplementary Provisions

  These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
