Sichuan Provincial Department of Civil Affairs

  In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Printing and Releasing'the Plan of the Institutional Reform of Sichuan Provincial Government'and'the Opinion on the Implementation of the Plan of the Institutional Reform of Sichuan Provincial Government’,Sichuan Provincial Department of Civil Affairs,which is a composing department of Sichuan Provincial Government (referred to as"SPDCAt"),is hereby established.

  Ⅰ. Adjustment of Functions

  1)      Canceling such items of administrative approval as released by the provincial government;

  2)      Canceling function of issuing welfare lottery amount;

  3)      Undertaking function of commending cadres from grass-roots mass self-governance organizations and community organizations devolved from Ministry of Civil Affairs of the People’s Republic of China; and

  4)      Reinforcing function of social-relief,and taking charge of overall planning of the development of urban and rural social-relief system.

  Ⅱ. Major Functions

  1)      To implement guidelines,policies,laws and rules on civil affairs promulgated by the Party and the State,be responsible for the drafting of local rules and regulations in relation to civil affairs,formulate development plans,work schemes and policies for civil affairs undertakings throughout the province,organize the implementation,supervision and inspection thereof;

  2)      To undertake functions of registering,administrating and supervising social groups,foundations and non-governmental non-enterprise entities;

  3)      To formulate policies,standards and implementation measures for provincial preferential treatment and special-care allowance,take charge of affairs in relation to preferential treatment,special-care allowance and subsidy to all entitled groups as well as compensations to casualties in state organs,be responsible for praising of martyrs,organize and guide work of supporting the army and giving preferential treatment to the families of servicemen and martyrs throughout the province,undertake relevant specific work of"Two Supporting" Work Leading Group Office of Sichuan Province;

  4)      To formulate resettlement policies and plans for accepting and settling retired soldiers,demobilized cadres,retired military cadres and retirees without military status who are transferred to local governments and organize the implementation thereof,provide guidance on work in relation to vocational skill training and employment of retired soldiers;

  5)      To formulate disaster relief policies,be responsible for organizing and coordinating disaster relief work,organize the construction of the emergency system for natural disaster relief work,be responsible for organizing the verification and issuance of disaster,manage and allocate state and provincial relief funds and materials and supervise the usage thereof,organize and guide the work of disaster-relief donation,undertake specific work of Provincial Committee for Disaster Reduction;

  6)      To take the lead in formulating provincial social relief plans,policies and standards,improve urban and rural social relief system,be responsible for matters in relation to the urban and rural subsistence security system,medical assistance,temporary assistance and people with no means of living support;

  7)      To formulate administration policies for provincial administrative divisions and procedures for the administration of administrative boundaries and geographic names,in charge of the establishment,cancelation,alteration of administrative regions at town level and above throughout the province and examination and submission for approval of the government site relocation as well as naming and name-changing of geographic names,organize and provide guidance on work in relation to demarcation and administration of administrative boundaries,coordinate and handle disputes over administrative boundaries,release official place names,regulate setting and management of name signs;

  8)      To formulate policies for the construction of urban and rural grass-roots mass self-governance and community,guide the implementation thereof,provide guidance on the development of community service system,put forward proposals for strengthening and improving the development of urban and rural grass-roots political power,guide community (village) residents'communities to carry out democratic election,division-making,democratic administration and democratic supervision,promote the construction of the grass-roots mass self-governance;

  9)      To formulate development plans,policies and standards for provincial social welfare undertakings,formulate procedures for social welfare agencies and guide the implementation thereof,organize to formulate policies for the promotion of charities,be responsible for the administration of welfare-lottery sales,organize to guide social donation work,provide guidance on work in relation to safeguarding the rights and interests of the elderly,orphans and the handicapped,take charge of the administration of prosthesis trade;

  10)   To formulate management policies for marriage,funeral,interment and adoption and organize the implementation thereof,be responsible for promoting the reform of marriage customs,funeral and interment,provide guidance on administrating agencies providing marriage,funeral and interment as well as relief service,take charge of marriage registration and adoption registration related to foreign residents throughout the province;

  11)   To formulate,together with relevant departments,development plans,policies and professional codes for provincial social work,promote the development of professional personnel in social work and relevant volunteer teams;

  12)   To guide and supervise usage and management of funds for civil affairs administration,take charge of administration of civil affairs statistics;

  13)   To handle relevant items of administrative approval as released by the provincial government; and

  14)   To undertake other tasks assigned by the provincial government.

  Ⅲ. Constitution of the Department

  On the basis of the above functions,15 internal offices are set up in the Department.

  1)      General Office (Division of Policies and Rules,Division of Administrative Approval)

  The General Office shall be responsible for work in relation to official papers and diagrams,conference organization,confidential documentation,files,security,confidentiality,administrative coordination,open administration,supervision and inspection as well as performance administration. The Office shall undertake work in relation to the management of civil affairs information and relevant press release. The Office shall be responsible for the drafting of local rules and regulations on civil affairs work. The Office shall provide guidance on and supervise civil administrative enforcement throughout the province. The Office shall take charge of publicity,training and education of civil affairs stressing the rules of law. The Office shall undertake affairs in relation to examining and verifying regulatory documents and work in relation to administrative reconsideration and respondence to administrative litigation of the Department. The Office shall organize to coordinate research and investigation activities of civil policy theories. The Office shall undertake relevant items of administrative approval of the Department.

  2)      Administration Bureau of NGOs (Enforcement and Supervision Bureau of Non-governmental Organizations)

  The Administration Bureau of NGOs shall formulate procedures of registration and administration of social groups,foundations,non-governmental non-enterprise entities and conduct pre-examination administration and enforcement supervision in accordance with jurisdiction. The Division shall undertake registration administration and enforcement supervision of agencies set by overseas NGOs within Sichuan Province. The Division shall take charge of information management work of NGOs. The Division shall,entrusted by Ministry of Civil Affairs of the People’s Republic of China,conduct administration of administrative agencies set by national NGOs. The Division shall guide and supervise the registration management work of social groups,foundations and non-governmental non-enterprise entities at municipal (prefectural) and town (district) level.

  3)      Division of Special Care (“Two Supporting" Work Leading Group Office of Sichuan Province)

  The Division of Special Care shall formulate local polices for preferential treatment and special-care allowance and supervise the implementation thereof. The Division shall be responsible for affairs in relation to preferential treatment,special-care allowance and subsidy to all entitled groups. The Division shall take charge of praise for martyrs. The Division shall be in charge of budget arrangements,allocation and management of special-care funds. The Division shall provide guidance on the construction and management of special-care hospitals,glorious homes and cemetery of revolutionary martyrs. The Division shall formulate local policies for supporting the army and giving preferential treatment to the families of servicemen and martyrs and supervise the implementation thereof. The Division shall organize and guide activities of supporting the army and giving preferential treatment to the families of servicemen and martyrs. The Division shall undertake specific work of"Two Supporting" Work Leading Group Office of Sichuan Province.

  4)      Resettlement Division

  The Resettlement Division shall formulate policies and plans for accepting and settling the retired soldiers,demobilized cadres,retired military cadres and retirees without military status and organize the implementation thereof. The Division shall manage and allocate resettlement funds. The Division shall guide administration and safeguarding work of military-supply stations,service and management agencies for retired military cadres. The Division shall provide guidance on work in relation to vocational skill training and employment of retired soldiers.

  5)      Division of Disaster Relief (Committee for Disaster Reduction Office of Sichuan Province)

  The Division of Disaster Relief shall formulate disaster relief policies and organize the implementation thereof. The Division shall undertake organizing and coordinating disaster relief work. The Division shall organize and guide the construction of the emergency system for the natural disaster relief work. The Division shall undertake work in relation to the verification,issuance of disaster as well as administration and supervision of national and provincial relief funds and materials. The Division shall,together with relevant parties,organize to coordinate work in relation to emergency transfer of disaster-afflicted people,reconstruction subsidy for ravaged houses of rural residents as well as livelihood relief to disaster-stricken people. The Division shall organize and guide disaster-relief donation. The Division shall formulate disaster-relief plans and organize the implementation thereof. The Division shall undertake specific work of Committee for Disaster Reduction of Sichuan Province and affairs in relation to international and national disaster-relief cooperation.

  6)      Division of Social Relief

  The Division of Social Relief shall formulate provincial social-relief plans,policies and standards and supervise the implementation thereof. The Division shall improve urban and rural social-relief system. The Division shall take charge of affairs in relation to urban and rural subsistence security system,medical assistance,temporary assistance and confirmation of urban low-income families. The Division shall formulate social-relief policies for five-guarantee families and organize the implementation thereof. The Division shall undertake allocation and supervision of funds for subsistence allowance by state and provincial revenue. The Division shall participate in formulating relevant methods of housing,educational and judicial relief. The Division shall undertake management work of social relief information.

  7)      Division of Grass-roots Political Power and Community Development

  The Division of Grass-roots Political Power and Community Development shall put forward proposals on reinforcing and improving the development of grass-roots political power. The Division shall guide community (village) residents'communities to carry out democratic election,decision-making,democratic administration and democratic supervision. The Division shall promote the development of grass-roots democracy. The Division shall organize to carry out commending work of model village autonomy units and harmonious community demonstration units. The Division shall provide guidance on commending cadres from grass-roots mass self-governance organizations and community organizations. The Division shall guide work in relation to the development of community service system and community volunteer registration work.

  8)      Division of Administrative Division and Geographic Names (Office for Demarcation Work of Sichuan Province)

  The Division of Administrative Division and Geographic Names shall formulate administration policies for administrative divisions and administration measures for administrative boundaries and geographic names. The Division shall work out place name plans for the province and issue standard names. The Division shall undertake the establishment,cancelation,alteration of administrative regions at town level and above throughout out the province and examination and submission for approval of the government site relocation as well as naming and name-changing of division names at town level and above. The Division shall organize and guide the setting and administration work of towns,streets,roads,alleys and villages and other name signs throughout the province. The Division shall organize and provide guidance on demarcation and administration of administrative boundaries throughout the province. The Division shall coordinate and handle disputes over administrative boundaries.

  9)      Division of Social Welfare and Charities Promotion

  The Division of Social Welfare and Charities Promotion shall formulate development plans,policies and standards for provincial social welfare undertakings. The Division shall formulate policies for safeguarding the rights and interests of the elderly,orphans and the handicapped. The Division shall formulate administration methods for social welfare agencies throughout the province and guide the implementation thereof. The Division shall be responsible for the management of welfare lotteries and provincial public welfare funds for welfare lotteries. The Division shall,together with relevant departments,implement supporting policies for social welfare enterprises. The Division shall provide guidance on qualification recognition of provincial social welfare enterprises. The Division shall organize to formulate development plans for the promotion of charities. The Division shall organize and guide social donation work.

  10)   Division of Social Affairs

  The Division of Social Affairs shall formulate provincial administration polices for funeral and interment,take charge of administration work of funeral and interment and promote funeral and interment reform. The Division shall be responsible for management of relieving people with no means of living support and assisting and protecting wandering juveniles. The Division shall undertake coordination work in relation to assisting inter-provincial and inter-municipal (prefectural) people with no means of living support. The Division shall provide guidance on administrating agencies engaging in funeral,interment and relief services.

  11)   Registration and Administration Division of Marriage and Adoption

  The Registration and Administration Division of Marriage and Adoption shall formulate local rules,regulations and policies for marriage and adoption work and organize the implementation thereof. The Division shall provide guidance on marriage registration and child adoption work throughout the province. The Division shall promote reform of marriage customs. The Division shall be responsible for marriage registration related to foreign residents,residents from Hong Kong,Macao and Taiwan and overseas Chinese. The Division shall undertake adoption registration work related to foreign children throughout the province. The Division shall undertake management work of the marriage registration and the adoption registration throughout the province. The Division shall provide guidance on management of marriage service agencies.

  12)   Division of Planning and Finance

  The Division of Planning and Finance shall formulate development plans for provincial civil affairs undertakings and supervise the implementation thereof. The Division shall provide guidance on and supervise the usage and management of funds for civil affairs undertakings. The Division shall be in charge of administrating civil affairs statistics. The Division shall be responsible for financing,internal auditing as well as supervising state-owned assets of the Department and its subordinate agencies.

  13)   Division of Letters and Visits

  The Division of Letters and Visits shall implement laws,rules and policies for work in relation to letters and visits from the public. The Division shall carry out researches and analysis of letters and visits in relation to civil affairs throughout the province. The Division shall take charge of receiving,treating,analyzing,investigating and reconciling cases of letters and visits from the public. The Division shall conduct supervision and inspection of major letters and visits'cases. The Division shall coordinate and handle mass emergencies in relation to civil affairs. The Division shall provide guidance on work in relation to maintenance of the stability of civil affairs system throughout the province.

  14)   Personnel Division (Division of Social Work)

  The Personnel Division shall take charge of affairs in relation to personnel administration,institutional organization,education and training of the Department and its subordinate agencies. The Division shall undertake matters in relation to scientific and technological administration and trade standardization of civil affairs. The Division shall,together with relevant parties,formulate development plans,policies and professional codes for social work. The Division shall promote the development of personnel in social work and relevant volunteer teams.

  15)   Division of Affairs of Retired Staff

  The Division of Affairs of Retired Staff shall be responsible for affairs in relation to retired staff and provide guidance on the work in relation to retired staff in the line of directly subordinate agencies throughout the province.

  The Party Committee of the Department shall be responsible for work in relation to Party-and-mass relationship in the Department and subordinate agencies. Its work organs are to be set up by the Party Group of the Department in accordance with provisions by the CPC Sichuan Provincial Committee.

  Ⅳ. Personnel and Number of Leaders

  The Department of Civil Affairs of Sichuan Province is to have 126 staff,including one Director and 4 Deputy Directors. Party secretaries are to be appointed in accordance with provisions by the CPC Sichuan Provincial Committee. The Department is to have 16 officials of leading roles of divisions or equivalents (including one full-time deputy secretary for the Party Committee of the Department or director of the Party Office of the Department) and 32 officials of assisting roles of divisions or equivalents.

  The Department is to have 1 official under separate administration and 2 officials under separate administration transferred from military forces.

  The Department is to have 3 positions for special personnel of disciplinary inspection and supervision delegated by Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province,including one Head of the Disciplinary Inspection Team (Special Commissioner for Supervision) and one Director of Supervision (Deputy Head of the Disciplinary Inspection Team). All the above personnel shall be subject to the administration provided in the Circular of the General Office of the CPC Sichuan Provincial Committee and the General Office of Sichuan Provincial Government on Transmitting the'Opinion of Sichuan Provincial Commission of Disciplinary Inspection,Organization Department of the CPC Sichuan Provincial Committee,the Office of Institutional Establishment of Sichuan Province and Supervisory Department of Sichuan Province Concerning the Implementation of Centralized Administration on Delegated Organs of Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province'(ChuanWeiBan [2005]No. 30).

  The Department is to have 2 service personnel for retired staff.

  Ⅴ. Miscellaneous

  1)      Map of Administrative Division of Sichuan Province carrying information of administrative divisions shall be complied by the Department of Civil Affairs of Sichuan Province and Sichuan Bureau of Surveying and Mapping.

  2)      The Office for Work Committee of the Elderly of Sichuan Province is to be under the administration of the Department of Civil Affairs of Sichuan Province.

  3)      Administration Bureau of NGOs (Enforcement and Supervision Bureau of Non-Governmental Organizations) can be known as Administration Bureau of NGOs of Sichuan Province (Enforcement and Supervision Bureau of Non-Governmental Organizations of Sichuan Province) to the public.

  4)      Provisions for the establishment,functions,and institutional organization of subordinates shall be formulated otherwise.

  Ⅵ. Supplementary Provisions

  These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
