Sichuan Provincial Bureau of Environmental Protection

  In accordance with the Circular of the CPC Sichuan Provincial Committee and Sichuan Provincial Government on Printing and Releasing'the Plan of the Institutional Reform of Sichuan Provincial Government'and'the Opinion on the Implementation of the Plan of the Institutional Reform of Sichuan Provincial Government'(ChuanWeiFa[2009] No.24),the Sichuan Provincial Bureau of Environmental Protection ,which is directly under Sichuan Provincial Government (referred to as the" SPBEP"),is hereby established.

  I.       Adjustment of Functions

  1)             Transferring the functions of the former Bureau of Environmental Protection of Sichuan Province to the Environmental Protection Bureau of Sichuan Province;

  2)             Canceling such items of administrative approval as released by the provincial government;

  3)             Reinforcing the overall coordination function of environmental policies,plans and major problems;

  4)             Reinforcing the instruction,coordination and supervision of environment control,environmental regulation and ecology protection;

  5)             Reinforcing the control on the total emission volume,and implementing pollution reduction targets.

  II.     Major Functions

   1) To implement guidelines,policies,laws,rules and regulations on environment protection promulgated by the State. To Draft local rules and regulations and ensure the implementation,supervision and inspection,and draw up and implement policies,plans of environmental protection throughout the province,and participate in the laying down of the policies of economy,technology,resource allocation and industry related to environment protection,and organize and draw up Environmental Function Zoning throughout the province,and organize and drafting the standard for all kinds of environment in the province,technical regulation,key area,pollution prevention in river valleys and regions,plans for environment protection of drinking water sources,and participate in the function zoning of the province.

  2) To take charge of the coordination and supervision of the major environmental problems. To take the lead in coordinating the investigation of major environmental pollution accident and ecological damage incidents. To guide and coordinate the response and early warning of environment emergencies,coordinating to solve dispute of trans-regional,basin environment pollution,the pollution prevention of the key area and basin environment throughout the province.

  3) To be responsible in the implementation of pollution reduction. To organize and make plan for control on the total emission volume of the major pollutants,putting forward the name of the pollutants and the control targets,supervisingcontrol task completion of all area. To take the lead in implementing target-related responsibility,and examine the total emission volume of the pollutants and publish the result.

  4) To take charge in environment protection investment management. To be responsible in proposing the scale and direction of the fixed asset investment in the environment protection throughout the province,opinion of the financial and capital arrangements of the province,examining and approving yearly plan of the fixed asset investment throughout the province in accordance with the provision,and support relative departments in organizing,implementing and supervising. According to law,to charge on discharge,defer,reduce and exempt from charge and inspection work. To participate in guiding and promoting circular economy and environmental protection industry,fighting against climate change.

  5) To take charge of the prevention and control of the environment protection and environmental damage. To assess the environmental impact of the major economical and technological policies,development program,major economic development plan committed by the provincial government. To bring forward opinions about environmental impact of the draft of the local regulation and rule concerning environmental protection of the province,and to examine and approve environmental impact statement of the program as specified,examine and approve environmental impact statement of major development and construction region,comprehensive planning,special planning.

  6) To take charge the supervision and management of the environmental pollution prevention. To develop and implement pollution prevention system of the water body,air,soil,noise,light,fetor,solid waste,chemical and motor vehicle. To organize and implement pollutant discharge registration,and to discharge permit,examine and approval of environmental pollution control quality. To be responsible for the granting and managing of the certificate for hazardous waste. To supervise and manage the environment protection of the drinking water sources,organizing and guiding the comprehensive improvement of towns and villages throughout the province. To be responsible for environmental inspection and environmental protection administrative inspection.

  7) To guide,coordinate and supervise the ecological protection of the province. To organize and draft the plan for ecological protection of the province and supervise it,and assess the ecological environment quality situation,and supervise natural resources development activities with ecological impact,major ecological environment development and ecological rehabilitation,and guide,coordinate and supervise the environment protection of all kinds of natural reserve area,scenic spot and forest park,bring forward opinions on the inspection and assessment of newly-built national,provincial natural reserve,and coordinate and supervise wildlife protection,wet land protection,desertification control. To guide and coordinate agricultural environmental protection,ecological demonstration zones construction,eco-agriculture construction and supervision of biological technology environment safety,take the lead in biological species,and organize and coordinate the protection of biodiversity. To carry out ecology development.

  8) To be responsible for the supervision and management of the nuclear safety and radiation safety of the province. To carry out the policy,regulation and technological standard of nuclear safety and radiation safety. To be in charge of the radiation emergency management,and participate in the work of nuclear accident. To supervise and manage radiation source and x-ray apparatus safety,and supervise and manage the nuclear facility safety,and supervise and manage the pollution prevention of nuclear facility,nuclear technology,electromagnetic radiation,and radioactive mineral resources. To be responsible for the production,selling,x-ray apparatus,use and examine and the selling,use and examine of radioisotope. To be in charge of the management work of "three at the same time" with radiation construction program,and supervise and manage the control of nuclear material,the design,production,installation and nondestructive inspection of nuclear safety equipment for civilian use. To be responsible for nuclear and radiation supervision work.

  9) To take charge of environment monitoring,statistics and information release. To supervise and implement all kinds of standard enacted by the country,and carry out the national environment monitoring system and regulation,and make environment monitoring system and regulation of the province,and organize and implement the environment quality monitoring and pollution source  supervisory monitoring. To organize,investigate and assess the environment quality of the province,price forecasting and pre-warning,and build and manage the environment monitoring net and environment information net,and set up and

  carry out environment quality announcement system,and publish the comprehensive environmental report of the province and major environmental information,and to be responsible for environment statistics work.

  10)To launch science work for the environment protection work,and manage scientific research achievements and the application,and organize major scientific research for environment protection and technology pilot projects,and promote the building up of the environment technology management system.

  11) To launch international exchange and cooperation for environment protection throughout the province. To participate in the coordination of the major international activities and regional cooperation of environment protection,and manage the international economic cooperation in the line of local environment protection,and coordinate and implement foreign investment program,and handle foreign environmental protection affairs,to take charge of the liaison work with international environment protection organizations.

  12) To organize and coordinate the publicity and educational work of environmental protection throughout the province,and make and organize to implement the program and plan of the publicity and educational work of environment protection throughout the province,and launch publicity and educational work of eco-civilization construction and the development of an environment-friendly society,and promote the public and social organizations to participate in environmental protection,and work with other departments to honor and award the units and individuals for their outstanding achievements in the field of environment protection and improvement in accordance with law.

  13) To work with other departments with the work in organizing the reform of administrative management system in the line of local environmental protection,and in the guidance of the team building,profession improvement,construction of spiritual civilization in the line of environmental protection,planning and organizing the on-the-job training and further education in the line of environmental protection throughout the province.

  14) To handle relevant items of administrative approval as released by the provincial government.

  15) To undertake other tasks assigned by the provincial government.

  Ⅲ Constitution of the Bureau:

  On the basis of the above functions,15 internal offices are set up in the Bureau.

  1) The General Office

  The General Office shall deal with administrative affairs and coordinate daily work. The General Office shall deal with affairs in relation to secretary,official papers and telegrams,confidential documentation,open administration,reception,sanitation,security. The Office shall be responsible for environmental protection e-government and information management work. The General Office shall deal with drafting,organizing and implementing official affairs and manage all the regulations. The Office shall be responsible for the bureau’s basic construction and administration and logistics. The Office shall coordinate investigation of major environmental protection special. The Office shall also deal with the bills and proposals of NPC member,member of the CPPCC National Committee

  2) Office for Policies and Rules

  The Office for Policies and Rules shall take charge of the drafting of regulative documents concerning local environment protection,and carry out supervision and inspection on the enforcement of environment protection laws,rules,regulations and regulative documents. The Office shall carry out examination on administrative punishment,administrative hearing,administrative reconsideration,appeal,administrative mediation. The Office shall also carry out the research on environment protectionpolicy,and be in charge of drafting comprehensive documents for environment protection.

  3) Office for Planning and Finance

  The Office of Planning and Finance shall be responsible for the establishment and supervision the implementation of the environment protection plan and environmental function zoning. The Office shall participate in the examination of all kinds of plans concerning environment protection. The Office shall be responsible for putting forward the suggestions for the scale,direction of fixed assets investment and the arrangement of provincial funds of environment protection. The Office shall participate in managing the special fund for environment protection of the province. The Office shall deal with budget,settlement,supervision and management of government procurement,and the state-owned property management and auditing of the finance. The Office shall also be responsible for setting up environmental protection pilot program and major environmental protection program,and participate in the supervision and management of the environmental protection infrastructure facilities,and provide assistance for the management and use of sewage charges.

  4) Office of Technology Standards and Industry Development

  The Office of Technology Standards and Industry Development shall deal with the coordination of research on environmental protection and technology introduction and provide guidance in environmental science and technology research and technological demonstration project. The Office shall be responsible for management of the environmental protection scientific research,declaring of scientific research results and its application. The Office shall draw out environmental protection standard,and supervise and manage the implementation of national and provincial standard. The Office shall promote the construction of environmental technology management system,and undertake the examination of the operation certificate of environment pollution control and provide guidance and promote the circular economy and environmental protection industry.

  5) Office of the Control on the Total Emission Volume

  The Office of the Control on the Total Emission Volume shall implement the system for the control on the total emission volume and draw out control on the total emission volume of major pollutants,the pollutant emission permit,environmental statistics system and standard and supervise the implementation. The Office shall calculate and determine the environmental capacity of major regions and river basin. The Office shall work out and implement the plan for control on the total emission volume of major pollutants,and implement target-related responsibility system in environmental protection,evaluation system for reducing total emission volume. The Office shall deal with the research and implement environmental economic policy for the reduction of total volume of pollutants. The Office shall be responsible for environment statistics and general survey of pollutant source,and work out and publish yearly report on environmental statistics and statistical report. The Office shall also take the responsibility of the specific work of Leading Group Office for Reducing Total Emission Volume of Major Pollutants.

  6)Office for Environmental Impact Assessment (The Office for Administrative Examination and Approval)

  The Office for Environmental Impact Assessment shall carry out plan,the environmental impact assessment of construction program,environmental protection" three at the same time" and some other law,rule,regulation and system. The Office shall be responsible for planning,investigation and approval of the document for the environmental impact assessment of construction program,and the inspection of the environment protection of the completed construction projects. The Office shall also be responsible for evaluation work after the environmental impact,and undertake some other administrative examination and approval.

  7) Office for Environmental Monitoring and Investigation

  The Office for Environmental Monitoring and Investigation shall carry out national environmental monitoring system and regulation,and work out and implement environmental monitoring throughout the province,the plan,system and standard of the environmental information. The Office shall carry out environmental quality monitoring,pollution source supervisory monitoring,environmental emergency and early warning and monitoring and all kinds of special program investigation and general survey. The Office shall set up and implement environmental quality announcement system and formulate and publish environmental quality statement. The Office shall also provide guidance for environmental monitoring team building and profession improvement.

  8) Office for Pollution Prevention and Control

  The Office for Pollution Prevention and Control shall carry out law,rule,regulation and policy concerning pollution prevention and control. The Office shall set up and implement evaluation system for trans-city water body quality monitoring sections. The Office shall be responsible for supervision and management the pollution prevention and control of water body,air,noise,light,fetor,solid waste,chemical and motor vehicles. The Office shall carry out the work of "undertake treatment within a prescribed limit of time". The Office shall be responsible for supervision and management of urban centralized drinking water source reserve,operation permission of hazardous waste,pre-investigation of imported solid waste and toxic chemical,the pollution prevention and control of motor vehicles. The Office shall be responsible for quantitative appraisal of comprehensive rehabilitation of urban environment,provide guidance for the building of environmental protection model city. The Office shall be responsible for green credit and environmental inspection of listed companies. The Office shall work with other departments to launch the examination and supervision of mandatory clean production,and cooperate with relevant departments to promote circular economy.

  9) Office for Rural Environment Protection

  The Office for Rural Environment Protection shall carry out law,rule,regulation and policy for rural area and rural environment protection. The Office shall be responsible for guiding,coordinating and supervising rural environmental protection work. The Office shall work out and implement the plan for rural area pollution prevention and control,and coordinate the rural area and the agriculture area pollution prevention and control,supervise and manage the rural centralized drinking water source reserve,small river basin,lake and reservoir pollution,domestic pollution of village and small town,cultivation pollution,soil pollution prevention and control. The Office shall provide the guidance for ecological towns,ecological villages and other rural area ecological construction model zone building.

  10) Office for Nature and Ecology Conservation

  The Office for Nature and Ecology Conservation shall carry out law,rule,regulation of nature and ecology conservation,and draw out plans for ecology conservation,and evaluate the ecological quality,and supervise major ecological environment construction and ecological rehabilitation. The Office shall guide,coordinate and supervise and manage the environmental protection for all kinds of natural reserve area,scenic spot,forest park. The Office shall provide coordination for supervision of wildlife protection,wet land environment biotechnology environmental safety. The Office shall provide guidance for the development of organic food,the building of ecological demonstration and the development of ecological agriculture. The Office shall also undertake the protection,prevention and control of desertification. The Office shall be responsible for the protection of biodiversity,the supervision and management of specific work of Leading Group Office for the development of Ecological Province.

  11) Office for Nuclear and Radiation Safety Management

  The Office for Nuclear and Radiation Safety Management shall carry out law,rule,regulation concerning nuclear and radiation safety,and draw up local rule,standard and norm. The Office shall be responsible for nuclear technology application and the approval of environment impact assessment document for power transmission and transformation and other electromagnetic radiation devices and construction project with radioactive mineral resource,the supervision of "three at the same time". The Office shall be responsible for radiation environment monitoring,and provide assistance for Department of Environment Protection to supervise and manage the nuclear facility and transportation of radioactive materials and the supervision of uranium mine. The Office shall work out and implement the local nuclear and radiation emergency response plan. The Office shall be responsible for nuclear accident and investigation of the complaint,and participate in the prevention and handling of nuclear and radiation terrorist incident.

  12) Office for Environmental Emergency and Complaints Reception

  The Office for Environmental Emergency and Complaints Reception shall take the responsibility of the specific work of Environmental Emergencies Headquarters Office. The Office shall draw out major environmental emergency and ecological damage emergency response plan and supervise it. The Office shall be responsible for coordinating response and loss evaluation of major environmental emergency and ecological damage. The Office shall be responsible for the letter and visit concerning environment protection. The Office shall also be responsible for supervision and examination of environmental protection,and supervision in the line of local environment protection and internal affairs in the bureau.

  13) Office for Publicity,Education and External Cooperation

  The Office for Publicity,Education and External Cooperation shall organize and implement policies,regulations,planning of systems and publicity concerning the external cooperation of environmental protection. The Office shall organize and promote the education of environmental protection policies and publicity and education of law and environmental protection knowledge and undertake the news release. The office shall promote the participation of environmental protection of public and society organizations and undertake society recognition,and sum up and popularize the model of environmental protection and undertake the external exchange and regional cooperation of provincial environmental protection. The Office shall undertake the performance of the contract of international treaty of environmental protection and participate in the issues of environmental protection concerning foreign affairs. The Office shall be responsible for the establishment of external exchange network of environmental protection and make the use of the foreign-funded project for administration.

  14) Office for Personnel

  The Office for Personnel shall be responsible for personnel matters in relation to cadres in the Bureau and subordinate agencies,and responsible for cadres in the line of local environmental protection,and work with other departments in matters in relation to institutional organization in the line of local environmental protection. The Office shall be responsible for training and team building. The Office shall be responsible for political records examination for the person going abroad and provide overseas training. The Office shall conduct centralized administration for administrative award or punish in the line of local environmental protection,and work out and ensure the implementation of personnel management system in the line of local taxation,and work with other departments in matters in relation to the assessment of Professional Skills & Certificate and the exam for environmental protection qualifications.

  15) Office for Affairs of Retired Staff

  The Office for Affairs of Retired Staff shall be responsible for affairs in relation to retired staff and provide guidance on the work in relation to retired staff in the line of environmental protection throughout the province.

  The Party Committee of the Bureau shall be responsible for work in relation to Party-and-mass relationship in the Bureau and subordinate agencies. Its work organs are to be set up by the Party Group of the Bureau in accordance with provisions by the CPC Sichuan Provincial Committee. 

  Ⅳ Personnel and Number of Leaders

  The Environmental Protection Bureau of Sichuan Province is to have 91 staff,including one Director and 4 Deputy Directors. Party secretaries are to be appointed in accordance with provisions by the CPC Sichuan Provincial Committee. The Bureau is to have one General Engineer,one Nuclear Safety General Engineer,16 officials of leading roles of divisions or equivalents (including one full-time deputy secretary for the Party Committee of the Bureau or director of the Party Office of the Bureau) and 16 officials of assisting roles of divisions or equivalents.

  The Bureau is to have 1 official under separate administration,3 officials under separate administration transferred from military forces.

  The Bureau is to have 3 positions for special personnel of disciplinary inspection and supervision delegated by Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province,including one Head of the Disciplinary Inspection Team (Special Commissioner for Supervision),one Director of Supervision (Deputy Head of the Disciplinary Inspection Team). All the above personnel shall be subject to the administration provided in the Circular of the General Office of the CPC Sichuan Provincial Committee and the General Office of Sichuan Provincial Government on Transmitting the Opinion of Sichuan Provincial Commission of Disciplinary Inspection,Organization Department of the CPC Sichuan Provincial Committee,the Office of Institutional Establishment of Sichuan Province and Supervisory Department of Sichuan Province Concerning the Implementation of Centralized Administration on Delegated Organs of Sichuan Provincial Commission of Disciplinary Inspection and Supervisory Department of Sichuan Province.

   ⅤMiscellaneous

  1) Division of Functions Between Water Pollution Prevention and Water Resource Protection. The Environmental Protection Bureau of Sichuan Province is responsible for the water environment quality and water pollution prevention. Water Resources Bureau is responsible for the protection of the water resources. These two bureaus should enhance coordination and cooperation,set up a negotiation mechanism,to notify each other the situation of water pollution prevention and water resources protection,negotiate and solve major problems. The Environmental Protection Bureau publishes water environment information,and is responsible for the accuracy and timeliness of the information. Water Resources Bureau publishes the hydrology and water resources information,in which the part concerning water environment quality should be consistent with the information of The Environmental Protection Bureau.

  2) Provisions for the establishment,functions,and institutional organization of non-profit-seeking institutions under provincial level shall be formulated otherwise.

  Ⅵ Supplementary Provisions

  These provisions are subject to the interpretations and adjustment by the Commission of Institutional Organization of the CPC Sichuan Provincial Committee in accordance with specified procedures.
